1. Acceptance of Terms
By accessing or using Vixpe (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not use the Platform. These terms apply to all visitors, users, and others who access or use Vixpe.
2. User Accounts
To access certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it up to date.
You must be at least 16 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Platform.
3. User Content
You retain ownership of any content you upload, post, or share on Vixpe, including but not limited to images, 3D models, designs, prompts, and comments (“User Content”). By posting User Content, you grant Vixpe a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Platform.
You represent and warrant that you own or have the necessary rights to post your User Content and that it does not violate any third party's rights, including intellectual property, privacy, or publicity rights.
4. Intellectual Property
The Platform and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Vixpe and its licensors. The Platform is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
5. Prohibited Conduct
You agree not to:
- Upload content that is unlawful, defamatory, obscene, or that infringes on the rights of others
- Impersonate any person or entity or falsely state your affiliation with a person or entity
- Use the Platform to send spam, unsolicited messages, or engage in any form of harassment
- Attempt to gain unauthorized access to other user accounts, the Platform's systems, or any connected networks
- Use automated means, including bots, scrapers, or crawlers, to access or collect data from the Platform without our express permission
- Upload or distribute viruses, malware, or any other malicious code
6. Termination
We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will cease immediately. You may also delete your account at any time through your account settings.
7. Disclaimers
The Platform is provided on an “as is” and “as available” basis without any warranties, expressed or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any defects will be corrected.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Vixpe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.
9. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Platform after revisions become effective, you agree to be bound by the revised terms.
